The terms “we”, “us”, “our”, “TMC”, “The Ecotourist” and “The Mangrove Concept” refer to The Mangrove Concept as registered in the Trade Register of the Dutch Chamber of Commerce under the number 73838136, also d/b/a as “The Ecotourist”.
The term the “Site” refers to mangroveconcept.com, mangroveconcept.nl, the-ecotourist.com, the-ecotourist.nl, and all online class sites connected with The Mangrove Concept. The term “user,” “you” and “your” refers to site visitors, customers and any other users of the Site.
The Mangrove Concept provides a website where users can read articles on personal development, storytelling, lifestyle, motivation and small business management and a service where users may purchase online classes, workshops, subscriptions and products related the aforementioned (the “Service”).
Use of mangroveconcept.com and mangroveconcept.nl, including all materials presented herein and all online services provided by “The Mangrove Concept” (“TMC”), is subject to the following Terms and Conditions. These Terms and Conditions apply to all site visitors, customers, and all other users of the Site. By using the Site or Service and/or ordering a product from the Site, you agree to these Terms and Conditions, without modification, and acknowledge reading them.

Use of the Site + Service
To access or use the Site, you must be 18 years or older and have the requisite power and authority to enter into these Terms and Conditions. Children under the age of 18 are prohibited from using the Site.
Information provided on the Site and in the Service related to storytelling, personal development, small business management and other information are subject to change.
TMC makes no representation or warranty that the information provided, regardless of its source (the “Content”), is accurate, complete, reliable, current or error-free. TMC disclaims all liability for any inaccuracy, error or incompleteness in the Content.
Special terms and conditions online/offline (coaching) programs
Through courses, TMC shares knowledge, experience and tools in line with specific course goals and objectives. Aside from following the course(s) you will have to expand sufficient personal time and resources towards the achievement of these goals. The success of the course is in large parts dependant on your own efforts. We will, to the best of our abilities and within reason, attempt to provide you with the proper tools and information to realise course goals and achievements, and help you as best we can within the framework of the course(s). The support TMC provides is course-dependent, as described on the website, and is subject to the Terms and conditions.
Materials and licenses
TMC aims to ensure online availability of the purchased course materials for all participants. This can however not be fully garuanteed. Should (parts of) course materials be removed or transferred to another URL, we shall inform you as such 3 (three) months in advance through e-mail such that you will be able to download and personally retain relevant course materials. Notifications in this regard shall be send to your e-mail address. It is your own responsibility to provide us with a valid e-mail address.
Account Creation
You can visit and browse the Service without becoming a registered user, but you will not be able to sign up for or receive emails through the Service, unless you are a registered user of the Service. You can sign up to become a registered user of the Service by completing the registration process on the Site at www.mangroveconcept.com/subscribe
Upon registration, you are required to provide information about yourself, including your name, email address, username and password and other personal information. You agree that any registration information you give to TMC will always be accurate, correct and up to date. You must not impersonate someone else or provide account information or an email address other than your own.
Lawful Purposes
You may use the Site and Service for lawful purposes only. Your account must not be used for any illegal or unauthorised purpose. You must not, in the use of the Service, violate any laws in your jurisdiction.
You agree to be financially responsible for all purchases made by you or someone acting on your behalf through the Site. You agree to use the Site and to purchase services or products through the Site for legitimate, non-commercial purposes only.
You shall not post or transmit through the Site any material which violates or infringes the rights of others, or which is threatening, abusive, defamatory, libellous, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law.
Notice to International Users
The Service is controlled and operated by The Mangrove Concept from its office(s) in Rotterdam, the Netherlands. We do not make any representations that the Service or any Materials are available or appropriate for use in your location. You agree to comply with all local rules applicable to you regarding user conduct on the Internet and acceptable content. You also agree to comply with all applicable laws regarding the transmission of technical data exported from the Netherlands or the country in which you reside.
Our Management of the Service; User Misconduct
Our Right to Manage the Service. We reserve the right, but do not undertake the obligation to: (i) monitor or review the Service for violations of these Terms of Use and for compliance with our policies; (ii) report to law enforcement authorities and/or take legal action against anyone who violates these Terms of Use; (iii) manage the Service in a manner designed to protect our and third parties’ rights and property or to facilitate the proper functioning of the Service; (iv) screen our users, or attempt to verify the statements of our users and/or (v) monitor disputes between you and other users or to terminate or block you and other users from using the Service.
Interactions with other Users. Please choose carefully the information you share through the Service and that you give to other users of the Service. You assume all risks associated with dealing with other users with whom you come in contact through the Service.
Refusal of Service
TMC reserves the right to refuse service to any order, person or entity without obligation to assign reason for doing so.
TMC reserves the right to limit the number of participants in any given online class or workshop. TMC may at any time change or discontinue any aspect or feature of the Site or Service.
Order Confirmation
We will email you to confirm the placement of your order and with details concerning product or service delivery. In the event that there is an error in this email confirmation, it is your responsibility to inform us as soon as possible.
If you have signed up for an online class or workshop, confirmation that we have received your order and payment does not constitute acceptance into the class or workshop. We will email you separately to confirm that you have been accepted into the class or workshop.
If you have submitted a deposit or payment in full for a service, TMC has the exclusive right to deny service if deemed necessary. If service is denied, a refund will be provided in full.
Together with the confirmation email, these conditions, including any follow-up order or modified or additional order, form the entire Agreement between you and TMC. Any prior agreements, arrangements, agreements or statements will hereby lapse.
Cancellations, Refunds & Returns of Digital Products
Digital products (i.e. online courses, workshops, master classes, podcasts, webinars, e-books) offered by TMC cannot be canceled and are non-refundable after you’ve received access due to their online nature. Once you have received your login details and thus have access to the online learning environment, cancellation is no longer possible.

Product Description
We endeavour to describe and display the Service as accurately as possible. While we try to be as clear as possible in explaining the Service, please do not accept that the Site is entirely accurate, current, or error-free. From time to time, we may correct errors in pricing and descriptions, because we make mistakes, like any human. We reserve the right to refuse or cancel any order with an incorrect price listing.
Material You Submit to the Site
You shall not upload, post or otherwise make available on the Site any artwork, photos or other materials (collectively “Materials”) protected by copyright, trademark or other proprietary right without the express written permission of the owner of the copyright, trademark or other proprietary right.
The burden of determining that any Materials are not so protected rests entirely with you. You shall be liable for any damage resulting from any infringement of copyrights, trademarks, or other proprietary rights, or any other harm resulting from such a submission and shall indemnify TMC from any claim against TMC resulting from your posting of Materials to the Site.
For all Materials submitted by you to the Site, you automatically represent or warrant that you have the authority to use and distribute the Materials, and that the use or display of the Materials will not violate any laws, rules, regulations or rights of third parties.
TMC reserves the right to remove from the Site any Materials submitted by you that it deems inappropriate for the Site or that appears to violate these terms and conditions.
Social Media Guidelines
If you access or use any of TMC’s social media pages on Facebook, Pinterest, Twitter, Instagram or YouTube, or post any reviews or comments regarding your use of the Service on these social media services or other third party websites, we ask you to follow the following guidelines:
(i) Please be polite and courteous. Excessive name-calling, profanity, fighting words, discriminatory epithets, sexual harassment, bullying, offensive language or the like, are not acceptable.
(ii) All postings should come from a real person. We will delete any postings from our social media pages that we believe have come from fake or anonymous profiles.
(iii) Please verify that all information submitted is accurate and factual. Negative comments and complaints posted by you could be construed as claims about The Mangrove Concept or an individual and may be subject to libel laws and other legal claims.
(iv) We would like to hear about your complaints or concerns regarding the Service before you share them publicly with others so that we can help resolve them for you. Intellectual Property Rights to Your Materials
TMC does not claim ownership of Material you supply to TMC. However, the act of posting Material to the Site conveys an irrevocable, worldwide license to TMC to use and distribute the posted Material in connection with TMC’s website and any related TMC publications.
You retain copyright ownership and any other rights you may rightfully hold in any content that you submit through the Service.
By submitting Material to TMC, you agree to hold TMC harmless from and against all claims, liabilities and expenses arising out of any potential or actual copyright or trademark misappropriation or infringement claimed against you.
Our Intellectual Property
All the Content provided on the Site and in the Service, including all products and all online class and workshop materials are the intellectual property of TMC. The Content of the Site and Service are protected by Dutch copyright law.
You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the Content of the Site or the Service, in whole or in part without our prior written consent.
You may not remove any trademark, copyright, or other notice from the content of the Site or the Service.
We reserve the right to immediately remove you from the Service, without refund, at to pursue all available legal remedies against you if you are caught violating this intellectual property policy.
In other words, please do not steal any of my content and try to sell as your own.
Affiliate Disclaimer
The purpose of this website is to be educational. I share many ideas here, and sometimes suggestions for books, tools, websites, and ways to make a scene with your life and business. Some of the links to these tools and websites are regular links, and some of these links are links that, if you click them and purchase, I might get a commission in exchange.
Of course, I’m only recommending things that I think are great tools, not because I’m getting money for it. That’s just “cherry-on-top” bonus money for my Brazil fund. Because everyone should have a dream fund. Right?!
Limitation of Liability
You agree that under no circumstances shall we be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the Site or Service. Additionally, TMC is not liable for damages in connection with (i) any failure of performance, error, omission, denial of service, attack, interruption, deletion, defect, delay in operation or transmission, computer virus or line or system failure; (ii) loss of revenue, anticipated profits, business, savings, goodwill or data; and (iii) third party theft of, destruction of, unauthorised access to, alteration of, or use of your information or property, regardless of our negligence, gross negligence, failure of an essential purpose and whether such liability arises in negligence, contract, tort, or any other theory of legal liability.
The foregoing applies even if TMC has been advised of the possibility of or could have foreseen the damages. In those countries/states that do not allow the exclusion or limitation of liability for the damages, our liability is limited to the fullest possible extent permitted by law. In no event shall TMC’s cumulative liability to you exceed the total purchase price of the Service you have purchased from TMC, and if no purchase has been made by you TMC’s cumulative liability to you shall not exceed €100.
The legal claim on account of a culpable shortcoming is not admissible if you did not act with due speed after you discovered or should have reasonably discovered the shortcoming, by giving TMC written notice of default and reasons.
The right to claim on account of a culpable shortcoming expires one year after the written and reasoned notice of default.
The legal claim based on an attributable shortcoming is inadmissible if it is instituted later than five years from the day on which the Service was purchased.
Third-Party Resources
The Site and the Service contain links to third-party websites and resources. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content or policies of third-party websites or resources. Links to such websites or resources do not imply any endorsement by or affiliation with TMC. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.
Indemnification
You shall indemnify and hold us harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments and expenses, as well as third party claims and causes of action, including, without limitation, attorneys’ fees, arising out of any breach by you of any of these Terms and Conditions, or any use by you of the Site or Service.
You shall provide us with such assistance, without charge, as we may request in connection with any such defence, including, without limitation, providing us with such information, documents, records and reasonable access to you, as we deem necessary.
You shall not settle any third party claim or waive any defence without our prior written consent.
Confidentiality and Personal Data
You shall hold any confidential information in confidence and, unless required by law, not make confidential information available to any third party, or use confidential information for any purpose other than as provided for in using our website or Services.
Information is deemed to be confidential if the other party has been informed that is the case or if that is apparent from the nature of the information.
You shall take all reasonable steps to ensure that confidential information to which you have access is not disclosed or distributed by any other person in violation of these terms and conditions.
You acknowledge that details of the Service constitute our confidential information.
If TMC is obliged pursuant to a statutory provision or a legal ruling to disclose confidential information to third-parties designated by the law or the court with competent jurisdiction, and the TMC is unable to invoke a right to privilege recognised or permitted by statute or by the court with competent jurisdiction, TMC is not obliged to pay compensation for damages or other compensation and the counterparty is not entitled to dissolve the contract on the ground of any losses thus caused.

Effect of Headings
The subject headings of the paragraphs and subparagraphs of this Agreement are included for convenience only and shall not affect the construction or interpretation of any of its provisions.
Waiver
No waiver of any of the provisions of this Agreement by TMC shall be deemed, or shall constitute, a waiver of any other provision, whether or not similar, nor shall any waiver constitute a continuing waiver. No waiver shall be binding unless executed in writing by TMC.

All notices, requests, demands, and other communications under this Agreement shall be in writing and properly addressed as follows:

Complaints
If you are dissatisfied with the performance of the Agreement, you must let us know as soon as possible by sending a clear description of the complaint in an email to susanna(at)mangroveconcept.com.
Complaints must be reported within 14 (fourteen) days after following a specific program / after it has been discovered. If you report the complaint later, you are no longer entitled to repair, replacement or compensation.
Even if you send a complaint, your obligation to pay continues to exist.
Governing Law; Venue; Mediation
This Agreement shall be construed in accordance with, and governed by Dutch law. The exclusive venue for any arbitration or court proceeding based on or arising out of this Agreement shall be the competent civil court of Rotterdam in the Netherlands, unless the law requires otherwise.
Initial Dispute Resolution. We are available by email at susanna(at)mangroveconcept.com to address any concerns you may have regarding your use of the Service. Most concerns may be quickly resolved in this manner. Each of you and TMC agree to use best efforts to settle any dispute, claim, question, or disagreement directly through consultation and good faith negotiations which shall be a precondition to either party initiating a lawsuit or arbitration.
EU dispute resolution:The parties agree to attempt to resolve any dispute, claim or controversy arising out of or relating to this Agreement by mediation, which shall be conducted under the then current mediation procedures of The European Commission’s platform for online dispute resolution (ODR): ec.europa.eu/consumers/odr, or any other procedure upon which the parties may agree.
The parties further agree that their respective good faith participation in mediation is a condition precedent to pursuing any other available legal or equitable remedy, including litigation, arbitration or other dispute resolution procedures.
We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
Recovery of Litigation Expenses
If any legal action or any arbitration or other proceeding is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, default, or misrepresentation in connection with any of the provisions of this Agreement, the successful or prevailing party or parties shall be entitled to recover reasonable attorneys’ fees and other costs incurred in that action or proceeding, in addition to any other relief to which it or they may be entitled.
Severability
If any term, provision, covenant, or condition of this Agreement is held to be invalid, void, or unenforceable by an arbitrator or court of competent jurisdiction, the rest of the Agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.
Changed Terms
We may, at any time, amend these Terms and Conditions. Such amendments are effective immediately upon notice to you by us posting the new Terms and Conditions on this Site. Any use of the Site or Service by you after being notified means you accept these amendments. We reserve the right to update any portion of our Site and Service, including these Terms and Conditions at any time. We will post the most recent versions to the Site and list the effective dates on the pages of our Terms and Conditions.
Assignment
These Terms and Conditions bind and inure to the benefit of the parties’ successors and assigns. These Terms and Conditions are not assignable, delegable, sub-licensable or otherwise transferable by you. Any transfer, assignment, delegation or sublicense by you is invalid.
